Eurovaloraciones, S.A. is an appraisal company that aims to maintain a transparent relationship with its clients, informing them of how we collect and securely process any data they provide us when using our services.

To this end, we have prepared this Privacy Policy (hereinafter the Policy) which will allow our clients and/or users of services to consult the information they need or clear up any doubts they may have about the processing we carry out on personal data.

This Policy applies to all environments through which we interact with our customers and request personal data, especially websites, email or postal mail and telephone.

Therefore, this Policy does not apply to third-party websites, including those that can be accessed via a web link from our environments.

2. DATA COLLECTED

2.1. Directly from our clients/service users

The Company will collect personal data provided directly by our users/clients through the following sources:

a) Through the WEB page euroval.com, we collect the personal data that you provide us with your registration, as well as the information that derives from the access and use of the services that we offer you on this WEB, and from your own browsing, such as (i) the data provided when registering; (ii) the data provided in the use of the services; (iii) the data derived from the communications you maintain with us; (iv) the data derived from your browsing, such as cookies (information about the user's preferences when visiting a WEB), links and system information, and about which you can obtain more detail in the Cookies Policy of our WEB; (v) any other data that you authorize us to process.

b) By email, by telephone or in person: we collect the data provided by customers through our commercial or customer service and/or through external collaborators authorized to collect data from our clients as data processors, especially our technicians.

c) The data may also be collected through third parties that have been designated by the clients to act as their representatives in relations with our Company (especially Financial Entities).

Occasionally, we may collect personal data from other sources, such as property and/or commercial registers, town hall and regional government registers, compensation boards, etc., when the applicable regulations require checks to be carried out or data incorporated in these registers to be provided.

3. DATA CATEGORY

3.1. Client and user data

We collect the data necessary for the management of the requested service, especially:

a) Identification data: Name and surname, NIF/CIF, Address, telephone, email.

b) Economic, financial and insurance data, especially those related to the properties that are to be the subject of a report.

c) Commercial information data, especially those related to the exploitation of the property or business object of the report.

d) Data on transactions of goods and services.

3.2. Third party data

Eventually, for the provision of our services, it may be necessary for our clients to provide us with personal data of third parties, such as a contact person for the management of the visit, owner of the property, data of tenants and other holders of real rights, etc. The data collected will only be processed for the purposes of its incorporation in the valuation reports or other services prepared.

The incorporation into Euroval's databases of data corresponding to third parties will only proceed when they are necessary for the correct provision of the contracted services, and especially those necessary for the verification of the ownership and occupation status of the properties, the existence of encumbrances that burden the property and could affect its value, as well as to manage access and visits to the properties.

4. PURPOSE OF THE PROCESSING

Depending on how you interact with our WEB, we will process your personal data for the following purposes:

1) To attend to the requests or petitions that you make through the different means incorporated into our WEB

We only process the personal data that is strictly necessary to manage or resolve your request or petition.

2) For marketing purposes

To the extent that you subscribe to our Newsletter, your personal data will be used for the periodic sending of company newsletters.

3) For social media management

4) Usability and quality analysis for the improvement of our services (Cookies)

If you access our WEB, we inform you that we will process your browsing data for analytical and statistical purposes, that is, to understand the way in which users interact with our platform and thus be able to introduce improvements in it. Likewise, on occasions, we carry out actions and quality surveys aimed at knowing the degree of satisfaction of our clients and users and detecting those areas in which we can improve.

The legal basis that allows us to process your personal data also depends on the purpose for which we process them, in this way we will find different legal bases under the following purposes:

6. CONSERVATION PERIOD

1) Information request

We will process your data for the time necessary to attend to your request or petition and subsequently 1 year.

2) Marketing

We will process your data until you request to unsubscribe or cancel your subscription to the newsletter.

3) Social networks

We will process your data for the time necessary to attend to your request or petition and as long as you are a follower of our profile.

4) Provision of the service (reports issued)

We will process the data for a minimum period of 10 years, a period that we understand is necessary to guarantee that both our clients and legitimate third parties can access them during the period in which the active operations carried out on the basis of the same are in force. Likewise, and given that the professional responsibility of our Company is subject to claim periods that are extended in time, the maintenance of the data is necessary to guarantee the defense of our interests until the expiry of the limitation period of the actions that could derive from the services.

The conservation periods reflected in this section will be applicable, without prejudice to their possible extension for legal issues that require a longer period.

Once the data conservation period has expired, these will be deleted or blocked, so that they will only be available to the Controller for their management before the courts or other competent Public Administrations that may require information within their legally established powers.

In no case will the data collected be used for automated decision-making or profiling.

7. RECIPIENTS

The data collected may be communicated to the companies of the group, as well as to third parties exclusively for the provision of each of the services, indicated in this Privacy Policy, which will be considered Data Processors of the Controller, guaranteeing the confidentiality and protection of the data communicated through the contract established between the parties.

Detail of Euroval Group companies:

The companies of the group may give access to or communicate your personal data without the consent of the owner, in the following cases:

a) With the Courts and Tribunals, State Security Forces and Corps and with other Administrative Authorities, especially the Bank of Spain, CNMV, Public Treasuries, or other authority, when we understand that they may legally require them from us

b) With third parties in charge of processing Euroval who perform functions on our behalf (including appraisers, external consultants and professional advisors, accounting auditors, IT providers who develop our technological systems or guarantee their security and other data processors) when the correct provision of the service requires access to the personal data of our Client, with whom in any case and to guarantee the security of your data, the companies of the group will sign the corresponding contract regulated of the obligations of each of said data processors.

c) Likewise, we may share your data with companies of the group, for internal administrative purposes

8. EXERCISE OF RIGHTS

As the owner of the personal data, you have the right to contact EUROVALORACIONES, S.A. at any time and free of charge, by writing to Plaza Constitución nº 2 Entlo – 03550 de San Juan de Alicante, or through the email account pd@euroval.com. In case of acting through a representative, you must attach a copy of a document that proves your identity and the corresponding representation. You may specifically refer to the rights you wish to exercise among the following:

EUROVALORACIONES, S.A. may deny the exercise of certain rights when required by a directly applicable rule or when there is a legal obligation that prevents it, as in the case of the conservation of data for the fulfillment of legal obligations.

Ultimately, if you consider that your rights have not been respected, you have the right to file a complaint with the Spanish Data Protection Agency (AEPD), with address at Calle Jorge Juan, nº 6, 28001 Madrid.

9. CHANGES IN THE PRIVACY POLICY

The owner reserves the right to modify this Privacy Policy to adapt it to new legislative or jurisprudential developments, as well as to industry practices.

These policies will be in force until they are modified by others duly published.

The use of the WEB attributes to whoever makes use of it the condition of user who accepts these conditions.

At EUROVALORACIONES, S.A., we are committed to the protection of personal information and the implementation of the best security practices. In this sense, we have adopted an Information Security Management System (ISMS) in accordance with international standards, with the aim of guaranteeing the confidentiality, integrity and availability of the data we manage.

Our ISMS includes policies, procedures and controls designed to protect personal information against both internal and external threats, ensuring compliance with current regulations on data protection, such as the General Data Protection Regulation (GDPR) and any other applicable legislation.

All EUROVALORACIONES, S.A. personnel are trained and committed to complying with our ISMS, which is reviewed and updated regularly to adapt to technological, regulatory and operational changes, in order to maintain the highest level of security in the processing of personal data.

In the event of any security incident that may compromise personal information, our response protocols will be activated immediately, including notification to the relevant authorities and those affected, as established in the applicable regulations.

12. EXCLUSION OF LIABILITIES

The companies of the group will not be liable for direct or indirect damages, nor for consequential damages and/or loss of profit, in the event of service interruptions, delays, errors or malfunctions, which originate from causes beyond their control, or are due to willful misconduct or negligence of the user, or originate from causes of force majeure.

Euroval has the right to temporarily suspend the services and contents of the website to carry out maintenance, improvement or repair operations thereof, without the user having any right to compensation for these concepts.

Euroval is not liable to the user and/or third parties for damages caused by the lack of veracity, accuracy, completeness and/or timeliness of the data transmitted.

Euroval is not responsible for the use that the user makes of the services and products of the website or its passwords, as well as any other material on the website, infringing the intellectual or industrial property rights or any other rights of third parties.
