Can I Build a Pool in My House?

You may have a house with a garden or a good patio. Or perhaps a small plot of land in your town house and you are thinking... of installing a pool. It would be great to have your own pool, it would mean hours and hours of enjoyment for your family.

And if you also combine it with an enclosure, imagine what it would be like to enjoy a heated pool all year round. But are you sure you can do it? Today we are going to analyze the question and try to answer the question of whether I can build a pool on my land.

Legal aspects to build a pool

In the first place is the legal aspect of the project. That is to say, you cannot build a pool just anywhere.

For this, the first thing is to consult the Land Law of your Autonomous Community in addition to the municipal regulations in this regard.

Both the communities and the town councils regulate the spaces and conditions in which a pool can be installed and what specific characteristics it must have. This way we will also know what requirements they ask of us and the different authorizations and licenses that we must present.

As a general rule, what these regional or local regulations do is allow a pool or not depending on the type of land where you want to install it.
To make it clear, we are going to briefly explain the 4 types of land that exist in Spain:

  • Urban land. This is all land that has some legal construction or in which it can be done, even if it does not exist at present. Urban land is often mistakenly associated with the land of cities, but this is not the case. Land built in a town or rural area is also urban land.
  • Rustic land. Nor is it any land in a town, as we have already explained in the previous point. Rustic land is that on which no type of building can be built. These are lands linked to agricultural or livestock farms or forest areas. Here you can only build some facilities linked to these farms, but pools under no circumstances.
  • Developable land. This is land that, although it is not urbanized at present and there is nothing built, may be urban in the future if it is requested and the competent authorities change its status to urban land.
  • Rural core land. This type of land only occurs in some rural areas of Spain. It is a type of land similar to urban, but with some specific characteristics and focused on rural areas.

Bearing this in mind, it must be taken into account that, in general, there will be no legal problems in installing a pool on urban land.

Complying with some condition or respecting certain rules, we could install our pool on urban land of our property.
The same would happen in developable land as long as its possibility of urbanization is requested and this is approved by the competent administrations.

While this is the case, nothing can be built on this type of land, not even a pool.
With regard to rural land, the most common thing is that a pool cannot be installed just as nothing can be built. And we say that it is the usual thing because, in certain circumstances, it can be built.
You can only build some facilities related to rural tourism on rural land.

For example, a campsite, a rural hotel, etc. In this case and with stricter regulations than for personal homes, this type of accommodation can be built on rural land. And therefore a pool could also be installed in them, but always linked to said establishment.

How to process the licenses to build a pool in your house

Well, if the land where you would like to install your pool meets the requirements, then it is time to apply for the corresponding licenses.
As a general rule, we will be asked for a project and a technical report of the land and the actions that we are going to analyze. This is because making a pool usually requires activities such as earthmoving, installation of pipes, light points, etc.

The City Councils and administrations in general, will always ask us for specific explanations to ensure that these measures do not involve alteration of the environment, environmental or public safety hazards, etc.
Evidently, this type of projects and necessary technical reports must be carried out by a collegiate professional. In addition, this same professional will be responsible for monitoring the works and certifying to the administrations that the execution of the work corresponds to what was established in the technical report submitted.

The technical report in question will include important data for the work itself. From the specific location, dimensions and size of the pool, execution times, human and material resources that will be used. This is important to ensure that the materials with which we will build will not pose a problem for health or for the environmental environment.

The same applies to the machinery that has to be used, as well as the safety measures during the works.

Of course, it goes without saying that if the report and the project do not adapt to current legislation, the building license will be rejected. The same would happen if, in the middle of the works, the authorities verify that the execution does not adapt to what was presented in the project when applying for the corresponding license and authorization.

Cost of building a pool

And now the last phase remains before getting down to work. Make a cost estimate and specify the budget. How much can it cost us to make a pool?
It will vary depending on the type of pool we want, if we use a standard prefabricated vessel or we want something personalized with irregular shapes or sizes.
As a reference and on average in Spain, building a standard rectangular pool 6 meters long by 3 meters wide usually costs about 14,000 euros its complete installation. To which an additional 10% can be added in the project phase, building licenses, etc.
